Property and Debt Rights

Property/Asset Distribution/Bets/Liabilities/Alimony.- All assets and liabilities need to be distributed, sometimes the distribution can be different from 50% to each and rather more to one party as basis of equalizing distribution. Remember that property rights include investments, savings, stock plan, retirement plans, businesses, and other kind of assets. Debts are also divided equally between the parties. Finally, alimony is paid by the spouse who has the ability to pay and is paid to the spouse that has the need.

Shared Visitation/Custody

Child custody is determined by the best interest of the child. There are several factors to be considered and the focus is always the best interest of the child and not by a parent's request.  A Parenting Plan - Both parents will generally be involved in the decisions of the child but there will be a primary home for the child and both will have the right to share and spend time with the child, unless the court determines that it will be detrimental for the child. Under current law a schedule will be drafted that becomes enforceable in court with financial and other penalties for breach.

Child Support

The non-primary residential parent will pay child support as per FLORIDA child support guidelines. Issues of tax dependency, medical, summer camp fees, day care are all considered. Generally child support cannot be waived and can be collected retroactively. Either party may seek to modify child support at any point in time.

Dissolution of Marriage
